Terms & Conditions
These Website Terms and Conditions apply to the use of the L.A. Property Law & Conveyancing website, including its content, functions and online forms (Website).
L.A. Property Law & Conveyancing is a division of Linda Ashley Law ABN 13 635 642 054. In these terms, “L.A. Property Law & Conveyancing”, “Linda Ashley Law”, “LAL”, “we”, “us” and “our” refer to Linda Ashley Law and its relevant officers, employees, contractors and agents.
By accessing or using the Website, you agree to these terms. If you do not agree to them, you must not use the Website.
1. Changes to these terms
1.1 LAL may amend these terms at any time by publishing the amended terms on the Website.
1.2 Amendments take effect when published, unless otherwise stated. Your continued use of the Website after amendments are published constitutes acceptance of the amended terms.
1.3 These terms apply in addition to the Privacy Policy and any other terms expressly applying to a particular Website service or function. If there is an inconsistency, any specific terms applying to that service or function will prevail to the extent of the inconsistency.
2. General information only
2.1 The content on the Website is provided for general information and reference purposes only.
2.2 Website content:
(a) is not legal, financial, taxation or other professional advice;
(b) is not intended to be comprehensive;
(c) may not apply to your particular circumstances; and
(d) must not be relied upon as a substitute for advice concerning a specific transaction or matter.
2.3 Laws, procedures, government requirements and market practices may change over time. Although reasonable steps may be taken to maintain Website content, LAL does not warrant that any content is current, complete or suitable for a particular purpose.
2.4 Before acting or refraining from acting on the basis of Website content, you should obtain advice that takes account of your circumstances, documents, objectives and any relevant deadline.
2.5 A person accessing the Website from outside Australia does so at their own risk and is responsible for compliance with the laws applicable in their location. Website content is principally prepared by reference to Australian law and, where relevant, specific State or Territory law.
3. No solicitor-client relationship
3.1 Accessing the Website, downloading material, requesting a quote, completing an online form or contacting LAL does not, by itself:
(a) create a solicitor-client relationship;
(b) constitute acceptance of instructions;
(c) require LAL to act or reserve capacity to act; or
(d) create a duty to take action concerning a deadline.
3.2 LAL will only act after agreeing to do so and completing any required engagement, identification, conflict-checking and client acceptance processes.
3.3 Unless and until LAL confirms that it has accepted instructions and is remunerated for doing so, you remain responsible for protecting your interests and meeting all applicable auction, offer, finance, settlement, signing, limitation and other deadlines.
3.4 Submitting information does not create a solicitor-client relationship. Although some communications with prospective clients may be legally privileged, this cannot be guaranteed. Please do not send sensitive or confidential information unless requested by us.
4. Quotes and online enquiries
4.1 Any quote or fee indication made available through the Website is indicative only unless expressly stated otherwise.
4.2 A quote may be subject to review after LAL receives and assesses the relevant contract, transaction documents and other information concerning the matter.
4.3 A quote does not constitute acceptance of instructions, confirmation that LAL can meet a deadline, or confirmation that no conflict of interest exists.
4.4 You must provide accurate and complete information when submitting an enquiry, requesting a quote or uploading documents. You should identify any auction, offer, signing, finance, settlement or other deadline prominently.
4.5 Submission of a document or enquiry does not guarantee that it will be reviewed before a relevant deadline. You should not assume that LAL is acting unless acceptance of the engagement has been expressly confirmed.
5. Permitted use
5.1 LAL grants you a revocable, non-exclusive and non-transferable licence to access and use the Website for lawful, personal and non-commercial purposes, subject to these terms.
5.2 You must not:
(a) use the Website for any unlawful, fraudulent or improper purpose;
(b) interfere with the operation, security or availability of the Website;
(c) introduce a virus, malware, malicious code or other harmful material;
(d) attempt to gain unauthorised access to the Website, its server or any connected system;
(e) use automated tools to scrape, extract, index or reproduce Website content without prior written consent;
(f) impersonate another person or provide false or misleading information;
(g) use the Website in a way that infringes another person’s rights; or
(h) use Website contact details to send unsolicited commercial electronic messages.
5.3 LAL may suspend, restrict or terminate access to all or part of the Website at any time, including where these terms are breached.
6. Intellectual property
6.1 Unless otherwise stated, copyright and other intellectual property rights in the Website and its content are owned by LAL or used by LAL under licence.
6.2 Subject to these terms and applicable law, you may:
(a) browse the Website;
(b) download or print a reasonable number of copies of Website content for personal and non-commercial use; and
(c) share a link to a complete Website page, provided that the source is clearly attributed and the link is not misleading or deceptive.
6.3 You must not, without LAL’s prior written consent:
(a) reproduce, publish, communicate, adapt, modify, distribute, sell or commercially exploit Website content;
(b) reproduce Website content on another website or platform;
(c) remove a copyright, trade mark or proprietary notice;
(d) frame or embed the Website or its content within another website; or
(e) use any LAL name, logo, trade mark, branding or content in a way that suggests sponsorship, endorsement or affiliation.
6.4 Nothing in these terms transfers any intellectual property right to you.
7. Links, linking and third-party content
7.1 The Website may contain links to third-party websites or may display content supplied by third parties.
7.2 Third-party websites and content are not controlled by LAL. Unless expressly stated otherwise, a link or reference does not constitute endorsement, approval or sponsorship of the relevant third party, website, product or service.
7.3 To the maximum extent permitted by law, LAL does not warrant the accuracy, currency, security, availability or suitability of third-party websites or content and is not responsible for any loss arising from access to or reliance upon them.
7.4 A third party may link to the Website only if the link:
(a) clearly and accurately identifies L.A. Property Law & Conveyancing as the source;
(b) is not misleading or deceptive;
(c) does not suggest an association, approval or endorsement that does not exist;
(d) does not damage LAL’s reputation; and
(e) does not frame or reproduce Website content.
7.5 LAL may require a link to the Website to be removed at any time.
8. Email addresses and electronic communications
8.1 Email addresses and other contact details published on the Website are provided for legitimate business communications only.
8.2 Publication of an email address does not constitute consent to receive unsolicited commercial electronic messages.
8.3 Electronic communications may be delayed, intercepted, corrupted or affected by technical issues. LAL does not guarantee that an electronic communication will be received, reviewed or responded to within a particular period.
8.4 If you receive an unsolicited, suspicious or offensive message that appears to originate from an LAL email address, you should not open any attachment or follow any link. The message should be reported promptly using independently verified contact details.
8.5 If you no longer wish to receive marketing communications, you may use the unsubscribe facility included in the communication or contact LAL directly. Service-related communications may still be sent where necessary.
9. Privacy and cookies
9.1 Personal information collected through the Website or otherwise will be handled in accordance with LAL’s Privacy Policy and applicable privacy laws.
9.2 The Privacy Policy forms part of these terms and should be read before submitting personal information through the Website.
9.3 The Website may use cookies and similar technologies to:
(a) support Website functionality;
(b) remember user preferences;
(c) monitor Website performance and usage;
(d) improve content and user experience; and
(e) support security, analytics or other legitimate operational purposes.
9.4 A cookie is a small data file stored on a user’s device. Browser settings may allow cookies to be blocked or deleted, but doing so may affect Website functionality.
9.5 Where the Website uses third-party analytics, mapping, communications or embedded-content services, those third parties may process information in accordance with their own privacy terms.
10. Website availability and security
10.1 LAL may change, suspend or discontinue any part of the Website without notice.
10.2 LAL does not warrant that:
(a) the Website will be continuously available or free from delay or interruption;
(b) defects or errors will be corrected;
(c) files or communications will be secure or free from viruses, malware or other harmful components; or
(d) unauthorised access, data loss or other security incidents will not occur.
10.3 You are responsible for using appropriate security measures, including current antivirus software, secure passwords and suitable data backups.
11. Limitation of liability
11.1 To the maximum extent permitted by law, LAL is not liable for loss, damage, cost or expense arising from or connected with:
(a) access to, use of, or inability to use the Website;
(b) reliance on Website or third-party content;
(c) an interruption, delay, error, omission or security incident;
(d) a virus, malware or other harmful technology or material;
(e) unauthorised access to, alteration of or loss of information; or
(f) failure to identify or meet a deadline where LAL has not expressly accepted instructions to act.
11.2 To the maximum extent permitted by law, LAL is not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, opportunity, goodwill, data or anticipated savings.
11.3 Where a statutory guarantee applies and liability cannot lawfully be excluded, LAL’s liability is limited, where permitted by law and at LAL’s option, to:
(a) supplying the relevant services again; or
(b) refunding the same amount paid for professional fees to LAL only.
11.4 This clause does not limit any liability under a separate costs agreement or engagement that cannot lawfully be limited.
12. Indemnity
To the maximum extent permitted by law, you indemnify LAL against loss, liability, cost or expense arising from your unlawful use of the Website, your breach of these terms, or your infringement of another person’s rights. This indemnity does not apply to the extent that the relevant loss was caused or contributed to by LAL’s negligence, unlawful conduct or breach of duty.
13. Severability
If a provision of these terms is invalid or unenforceable, it is to be read down to the extent necessary to make it valid and enforceable. If it cannot be read down, it is severed without affecting the remaining provisions.
14. No waiver
A failure or delay by LAL to exercise a right under these terms does not constitute a waiver of that right. A waiver is effective only if made in writing.
